Design Day Website, Terms of Purchase
Last updated: September 25, 2026
This page covers the Design Day Website. Buying something else? Read the terms for your product: Design Day Brand Kit, Design Day Combo, or Half Day.
These Terms of Purchase govern your purchase of a Design Day Website from Brookey Design Co., the trade name of Tau Rho Dominion Goods L.L.C. ("the Studio," "we," "us"). By checking the box on the booking form, typing your name as your signature, and completing payment, you ("the Client," "you") agree to these terms. This is a binding agreement. Please read it before you pay.
1. What you are buying
A Design Day Website is a website of up to six (6) pages, or an online store with up to twelve (12) products, each with up to ten (10) options such as sizes or colors, designed and built on a single Thursday or Friday of your choosing, 6:00 am to 2:00 pm Central Time, on the Squarespace or Shopify platform, and made live by the end of that day.
Included:
- Up to six pages, or an online store with up to twelve (12) products, each with up to ten (10) options such as sizes or colors, designed and built on your scheduled Thursday or Friday
- Mobile optimized, with basic SEO and a working contact form
- Website copy for your pages, written by us from your answers in the project folder and on the prep call
- A project folder with the questions you answer before the day
- A strict 30 minute prep call, held the Monday of your Design Day week at 12:30, 1:00 or 1:30 pm Central
- A same-day revision window, 12:00 pm to 2:00 pm Central on your Design Day
- Direct access to your project manager for the duration of the day
- A custom PDF guide covering how to update your own site
- Fourteen (14) days of functionality support following launch
A "page" means a standard site page such as Home, About, Services, or Contact. A long scrolling page is one page.
Not included: your Squarespace or Shopify subscription, your domain registration, photography, more than twelve (12) products or more than ten (10) options on a product (a larger catalog is quoted separately after we review it), custom code or custom functionality, and any work not listed above. Anything outside this list is separate work, quoted and agreed in writing before we start it.
2. Fees, tax and payment
The fee is $4,000.00 USD, or four (4) monthly payments of $1,050.00 USD ($4,200.00 total). Texas sales tax at 8.25% applies to all amounts and is added at checkout.
Payment is made through Stripe. Your Design Day is booked at checkout, whether you pay by card or bank transfer (ACH). If a bank payment fails, your date is released until it is paid.
If you choose the payment plan: the first payment is charged at booking and the remaining three are charged monthly on the same day of the month. If a payment does not go through, we will email you at the address on your order. You have seven (7) days from that email to update your payment method. If the payment is still outstanding after seven days, the entire remaining balance becomes immediately due, and we may withhold the PDF guide, support, and any further work until the account is current.
3. Refunds and cancellation
All fees are non-refundable. When you book, your date comes off our calendar and is no longer available to anyone else. If you cancel, stop the work, or become unreachable at any point after booking, the full fee remains due and is not refunded in whole or in part. This applies before your prep call, after your prep call, and on the day itself.
If you are on the payment plan, cancelling does not end the plan. The remaining payments stay due on their scheduled dates.
If we cancel: if we cancel your Design Day for any reason other than your breach of these terms, we refund every dollar you have paid.
Our right to decline. Within three (3) business days of your booking, we may decline the project and refund you in full, for any reason. Because Design Day is bought without a call first, this is how we keep the right to say no to work that is not a fit.
4. Rescheduling, and the content deadline
Your Design Day works because the decisions are made before it starts. We lock those decisions with you on your prep call, and that call is where we walk you through everything we need. Your project folder must be complete, with your answers and materials in our hands, no later than 11:59 pm Central the night before your Design Day.
If your folder is not complete by 11:59 pm the night before your Design Day, we will move your Design Day to the next available Thursday or Friday. That is not a penalty. We cannot write or build your site without it.
You may reschedule once at no charge with at least seven (7) days written notice. A second reschedule, or any reschedule with less than seven days notice, is subject to a rescheduling fee of $500.00 USD, or, at our discretion, may be treated as a cancellation under Section 3.
If you are unreachable on your Design Day, or you do not attend the 12:00 pm to 2:00 pm revision window, the day is still considered delivered and the fee is not refundable.
5. What you are responsible for
- Attending the prep call, and completing the project folder by 11:59 pm the night before your Design Day: your answers to the questions, brand assets, logins, and photos
- Providing your logo, colors and fonts. Design Day is not a branding project. If you do not have a brand yet, tell us on the form and we will point you to the right service
- Adding howdy@brookeydesign.com as a user on the accounts we need. We do not ask for and will not store your passwords
- Being reachable on your Design Day and present from 12:00 pm to 2:00 pm Central
- Designating one person with authority to approve the work. We take direction from that person only
- Reviewing everything before 2:00 pm. Once the day closes, what is live is what was approved
We do not accept feedback, revisions or direction that has been generated or rewritten by an AI tool.
6. Revisions
Your revisions happen on your Design Day, between 12:00 pm and 2:00 pm Central. You see the site, you tell us what to change, we change it. That window is the revision allowance for this service.
Once the day closes at 2:00 pm, the site is delivered. Changes requested afterward are new work, quoted separately at our then-current rates. This is different from our full-service projects, which include two rounds of revisions per deliverable. Those rounds do not apply to a Design Day.
Fourteen days of functionality support is not a revision window. It covers things that do not work, not things you want changed. See Section 7.
7. After launch
For fourteen (14) days after your site goes live, we fix functionality problems in our work at no charge: broken links, forms that do not submit, elements that do not display correctly, and similar.
That window does not cover design changes, new content, new pages, new features, changes you make yourself, or anything caused by a Squarespace or Shopify platform change. After fourteen days, our obligations under these terms are complete and we have no ongoing maintenance duty. Continued help is available and quoted separately.
8. Platform, domain and third-party services
Your site is built on Squarespace or Shopify, whichever we agree on before your Design Day. Your use of that platform is governed by its own terms, which you accept directly with them. You are responsible for your platform subscription, your domain registration and renewal, and any other third-party service the site depends on.
Some projects need third-party materials such as fonts, stock images, icons or plugins. You are responsible for obtaining and maintaining the licenses for those. We will tell you what a project needs. Where we purchase them for you, they are billed at cost.
We are not responsible for any third-party platform's outage, pricing change, feature removal or policy change.
9. Ownership
Once you have paid in full, we assign to you ownership of the final website content and design we create specifically for you.
Your website copy is drafted with the help of AI tools and edited by us (see Section 14). Once you have paid in full, we assign to you whatever rights we hold in that copy, including our edits, selection and arrangement. Text generated by AI may not be protected by copyright, and we make no promise that it is.
Until you have paid in full, that work remains our property and you hold a limited license to use the live site. If you are on the payment plan, your site goes live before the plan finishes. During that period you have full use of the live site under that license. If the plan defaults under Section 2 and stays unpaid, we may suspend or remove the work we created until the account is brought current.
We keep ownership of our own methods, templates, know-how, preliminary concepts, unused designs, and working files. You own the final site, not the way we build sites.
10. Your content
You represent that everything you give us, including text, images, logos and trademarks, is owned by you or properly licensed to you, and does not infringe anyone else's rights. You will indemnify, defend and hold us harmless from any claim, damage, liability or cost, including reasonable attorneys' fees, arising from the materials you provide or your use of the finished site.
11. Accessibility
We are not responsible for your website's compliance with the Americans with Disabilities Act, the Web Content Accessibility Guidelines, or any other accessibility law, standard or regulation, and we do not provide legal advice about accessibility. Accessibility requirements depend on your business, your industry and your customers. If accessibility compliance matters to your business, consult an attorney or an accessibility specialist.
12. Your legal pages
We do not draft, review or advise on your website's privacy policy, terms of use, cookie policy, or any other legal or compliance text. You are responsible for obtaining those from your own attorney or a legal template provider, and for making sure they meet the requirements that apply to you and your visitors. We will place text you provide onto the site. Placing it is not review or approval of it.
13. Names and trademarks
We do not perform trademark searches and we do not advise on whether a business name, product name, domain or tagline is legally available to use. Nothing we say about a name is legal advice or a clearance opinion. If you want to know whether a name is available, consult a trademark attorney before you use it.
14. How the work gets made
Every design we deliver is made by hand. The concepts, the direction, the layouts, the typography, and the final files are the work of a human designer, and we do not deliver AI-generated design.
Website copy is the exception. We write your copy on your Design Day from your answers, and we use AI tools to help draft it. Every section is reviewed and edited by us before it goes on your site, and you review it in your revision window.
We reserve the right to use AI tools elsewhere in our business, in areas that do not produce your design work. That includes scheduling, correspondence, internal notes, research and reference gathering, and general administration.
This describes our workflow and does not change Section 5, under which we do not accept AI-generated direction from you.
15. Portfolio, promotion and testimonials
After your site is live and paid for, we may show and describe the work in our portfolio, website, social media and case studies, and identify you as a client. If you give us a review or testimonial, in any format, we may quote it and use your name, business name and town in our marketing. Tell us in writing if you would rather we did not, and we will not.
16. No guarantee of results
We warrant that our work is original or properly licensed. We make no guarantee about any business, sales, search ranking or marketing result. Those depend on factors outside our control. Except as stated in these terms, the work is provided as is.
17. Limit of our liability
To the maximum extent the law allows, our total liability arising out of or related to these terms will not exceed the total fees you actually paid us. We will not be liable for indirect, incidental, special or consequential damages, including lost profits or revenue, even if we were told they were possible.
18. Confidentiality
Each of us will keep the other's non-public business information confidential and use it only to carry out this agreement. This does not apply to information that is public, was already known, or must be disclosed by law.
19. Independent contractor
We are an independent contractor, not your employee, partner, agent or joint venturer. We are responsible for our own taxes, tools and expenses, and we control how the work gets done.
20. Events outside our control
Neither of us is liable for a delay or failure caused by events beyond reasonable control, including illness, acts of God, power or internet failure, or third-party platform failure. If your Design Day is affected, we will reschedule it to the next available Thursday or Friday at no charge.
21. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. We will first try in good faith to resolve any dispute directly, and then through mediation, before either of us goes to court. Any action that does proceed must be brought in the state or federal courts located in Callahan County, Texas, and we both consent to that jurisdiction. The prevailing party is entitled to recover reasonable attorneys' fees and costs.
22. The whole agreement
These terms, together with your booking form and your order confirmation, are the entire agreement between us and replace any prior discussion. If any part is found unenforceable, the rest stays in force. Changes must be in writing and agreed by both of us. We may update these terms for future purchases; the version in effect on the date you paid is the version that governs your purchase.
23. Acceptance
By checking the box on the booking form, typing your name in the signature field, and completing payment, you agree to these Terms of Purchase. Your typed name is your electronic signature. Electronic acceptance is valid and binding under the federal E-SIGN Act and the Texas Uniform Electronic Transactions Act. Keep a copy of your order confirmation.
