Design Day Combo, Terms of Purchase
Last updated: September 25, 2026
These Terms of Purchase govern your purchase of a Design Day Combo from Brookey Design Co., the trade name of Tau Rho Dominion Goods L.L.C. ("the Studio," "we," "us"). By checking the box on the booking form, typing your name as your signature, and completing payment, you ("the Client," "you") agree to these terms. This is a binding agreement. Please read it before you pay.
1. What you are buying
A Design Day Combo is two consecutive design days: a brand identity built on Thursday and a website built on Friday, each 6:00 am to 2:00 pm Central Time.
Thursday, your brand. Included:
- Primary logo, secondary logo, and brand mark
- Color palette with hierarchy
- Typography system, headline and body, with sizes and weights specified
- One brand pattern, drawn for your brand
- Business card design, print ready
- Instagram highlight covers
- Your brand hub: a private web page where every final file lives, one click from download, kept online for as long as Brookey Design Co. operates. Please also download and keep your own copy of your files
- All files in 300 DPI PNG, 900 DPI PNG and SVG
You get one design direction, refined. The direction is agreed with you on the prep call, before Thursday begins. We do not present multiple concepts or alternate directions.
Friday, your website. Included:
- Up to six (6) pages, or an online store with up to twelve (12) products, each with up to ten (10) options such as sizes or colors, designed and built on the Squarespace or Shopify platform and made live by the end of the day
- Built on the brand finished on Thursday
- Mobile optimized, with basic SEO and a working contact form
- Website copy for your pages, written by us from your answers in the project folder and on the prep call
- A custom PDF guide covering how to update your own site
A "page" means a standard site page such as Home, About, Services, or Contact. A long scrolling page is one page.
Both days. Included:
- A project folder covering both days, with the questions you answer before the week starts
- One strict 45 minute prep call, held the Monday of your Design Day week from 2:00 to 2:45 pm Central, covering both days
- A same-day revision window, 12:00 pm to 2:00 pm Central, on each day
- Direct access to your designer on each day
- Fourteen (14) days of support following launch
Not included: your Squarespace or Shopify subscription, your domain registration, photography, naming, a full brand guidelines document, more than twelve (12) products or more than ten (10) options on a product (a larger catalog is quoted separately after we review it), custom code or custom functionality, packaging design, and any work not listed above. We do not name businesses. Brand photography is produced with Lasting Joy Photography, quoted separately, and does not happen on either day. Anything outside this list is separate work, quoted and agreed in writing before we start it.
2. Fees, tax and payment
The fee is $7,000.00 USD, or four (4) monthly payments of $1,850.00 USD ($7,400.00 total). Texas sales tax at 8.25% applies to all amounts and is added at checkout.
Payment is made through Stripe. Both days are booked at checkout, whether you pay by card or bank transfer (ACH). If a bank payment fails, your dates are released until it is paid.
If you choose the payment plan: the first payment is charged at booking and the remaining three are charged monthly on the same day of the month. If a payment does not go through, we will email you at the address on your order. You have seven (7) days from that email to update your payment method. If the payment is still outstanding after seven days, the entire remaining balance becomes immediately due, and we may withhold the PDF guide, support, and any further work until the account is current.
3. Refunds and cancellation
All fees are non-refundable. When you book, both days come off our calendar and are no longer available to anyone else. If you cancel, stop the work, or become unreachable at any point after booking, the full fee remains due and is not refunded in whole or in part. This applies before your prep call, after your prep call, between the two days, and on either day itself.
If you are on the payment plan, cancelling does not end the plan. The remaining payments stay due on their scheduled dates.
After Thursday. The Combo is one purchase, not two. If you stop after your Thursday has begun, Thursday's brand files are still delivered to you under Section 11, and Friday is not refunded, credited, rescheduled or exchanged for anything else, because the day was held, staffed and lost.
If we cancel: the Combo is sold as one engagement at one price and is not divided into day rates. If we cancel or cannot deliver either day for any reason other than your breach of these terms, we will reschedule both days together to the next available pair of dates at no charge to you. If we cannot deliver the engagement at all, we refund every dollar you have paid. We do not issue partial refunds against an individual day, because no individual day carries a price.
Our right to decline. Within three (3) business days of your booking, we may decline the project and refund you in full, for any reason. Because a Design Day is bought without a call first, this is how we keep the right to say no to work that is not a fit.
4. The two days are one product
Thursday and Friday are sold together and run back to back. That adjacency is the product. Friday's website is built by a person who watched Thursday's brand get made.
The price is the price of the engagement. Neither day is separately priced, separately refundable, or separately transferable. You cannot split the two days, move one without the other, swap one for a different service, drop one for a reduced fee, or apply one of them to a future project. If you need the two days separated, book the Design Day Brand Kit and the Design Day Website individually, at their own prices.
Thursday ends at 2:00 pm Central, and Friday starts at 6:00 am on the website. Work not finished by 2:00 pm Thursday does not carry into Friday. Friday is the website day.
5. Rescheduling, and the content deadline
Both days work because the decisions are made before they start. We lock those decisions with you on your prep call, and that call is where we walk you through everything we need. Everything for both days, your brand answers and materials and your website answers, photos and materials, must be in our hands by 11:59 pm Central on the Wednesday before your Thursday.
If your folder is not complete by then, we will move both days to the next available pair of dates. That is not a penalty and it does not count as one of your reschedules. Neither day functions without it.
You may reschedule once at no charge with at least seven (7) days written notice. Both days always move together. A second reschedule, or any reschedule with less than seven days notice, is subject to a rescheduling fee of $1,000.00 USD, or, at our discretion, may be treated as a cancellation under Section 3. The fee is the same whether one day or both are affected, because both always move together.
If you are unreachable on either day, or you do not attend that day's 12:00 pm to 2:00 pm revision window, the day is still considered delivered and the fee is not refundable.
6. What you are responsible for
- Attending the prep call, and completing the project folder by 11:59 pm Wednesday night: what the business does and who it serves for Thursday, and your answers about your pages, services and story, plus your photos, for Friday
- Having a business name you are committed to. Naming is not part of either day
- Agreeing the brand direction, the site map and the page list with us on the prep call
- Providing photos and any existing materials you want used
- Adding howdy@brookeydesign.com as a user on the accounts we need. We do not ask for and will not store your passwords
- Being reachable on both days and present from 12:00 pm to 2:00 pm Central on both
- Designating one person with authority to approve the work. We take direction from that person only
- Approving Thursday's brand by 2:00 pm Thursday. See Section 8
- Reviewing the site before 2:00 pm Friday. Once Friday closes, what is live is what was approved
We do not accept feedback, revisions or direction that has been generated or rewritten by an AI tool.
7. Revisions
You have two revision windows, one on each day, 12:00 pm to 2:00 pm Central. You see the work, you tell us what to change, we change it while you watch. Those two windows are the revision allowance for this service.
Thursday's revisions refine the direction agreed on your prep call. They are not a request for a different direction. Friday's revisions refine the site built that day.
Thursday's window closes Thursday. Brand changes cannot be raised on Friday. Friday's revision window is for the website only. This is not a technicality: the site is being built on Thursday's brand from 6:00 am Friday, and changing the brand mid-build is a rebuild of both.
Once a day closes at 2:00 pm, that day's work is delivered. Changes requested afterward are new work, quoted separately at our then-current rates. This is different from our full-service projects, which include two rounds of revisions per deliverable. Those rounds do not apply to a Design Day.
Fourteen days of support is not a revision window. See Section 9.
8. Thursday to Friday
At 2:00 pm Thursday, the brand as approved in that day's revision window is final, and it is the brand your website is built on.
If you have not approved the brand by 2:00 pm Thursday, we build Friday's website on the most recent version presented to you. We will not delay or cancel Friday, and Friday is not refundable on that basis.
If you ask us to change the brand after 2:00 pm Thursday, that is new work under Section 7. Applying a changed brand to a site that is already built is also new work, quoted separately, and it does not happen on Friday.
9. After launch
For fourteen (14) days after your site goes live, we fix functionality problems in our work at no charge: broken links, forms that do not submit, elements that do not display correctly, and similar. In the same window we answer file and format questions on your brand files.
That window does not cover design changes, brand changes, new content, new pages, new features, changes you make yourself, or anything caused by a Squarespace or Shopify platform change. After fourteen days, apart from keeping your brand hub online, our obligations under these terms are complete and we have no ongoing maintenance duty. Continued help is available and quoted separately.
10. Platform, domain, fonts and third-party services
Your site is built on Squarespace or Shopify, whichever we agree on before your Design Days. Your use of that platform is governed by its own terms, which you accept directly with them. You are responsible for your platform subscription, your domain registration and renewal, and any other third-party service the site depends on.
Your typography system may specify fonts we do not own and cannot transfer. Some projects also use stock images, icons or plugins. You are responsible for obtaining and maintaining the licenses for anything third party, including any commercial or web font license. We will tell you what your project needs. Where we purchase something for you, it is billed at cost. A font license we hold for production is not transferred to you by these terms.
We are not responsible for any third-party platform's or licensor's outage, pricing change, feature removal or policy change.
11. Ownership
Once you have paid in full, we assign to you ownership of the final brand assets and the final website content and design we create specifically for you.
Your website copy is drafted with the help of AI tools and edited by us (see Section 16). Once you have paid in full, we assign to you whatever rights we hold in that copy, including our edits, selection and arrangement. Text generated by AI may not be protected by copyright, and we make no promise that it is.
Until you have paid in full, that work remains our property and you hold a limited license to use your brand and the live site. If you are on the payment plan, your brand is delivered and your site goes live before the plan finishes. During that period you have full use of both under that license. If the plan defaults under Section 2 and stays unpaid, we may suspend or remove the website and revoke the license to the brand until the account is brought current.
We keep ownership of our own methods, templates, know-how, preliminary concepts, unused designs, sketches and working files. You own the final brand and the final site, not the way we make them.
12. Your content
You represent that everything you give us, including text, images, logos and trademarks, is owned by you or properly licensed to you, and does not infringe anyone else's rights. You will indemnify, defend and hold us harmless from any claim, damage, liability or cost, including reasonable attorneys' fees, arising from the materials you provide or your use of the finished brand or site.
13. Accessibility
We are not responsible for your website's or your brand's compliance with the Americans with Disabilities Act, the Web Content Accessibility Guidelines, or any other accessibility law, standard or regulation, and we do not provide legal advice about accessibility. Accessibility requirements depend on your business, your industry and your customers. If accessibility compliance matters to your business, consult an attorney or an accessibility specialist.
Color also varies between screens, printers, papers, fabrics and substrates. We supply your palette in the standard color values and we are not responsible for how a particular printer, vendor or device reproduces them.
14. Your legal pages
We do not draft, review or advise on your website's privacy policy, terms of use, cookie policy, or any other legal or compliance text. You are responsible for obtaining those from your own attorney or a legal template provider, and for making sure they meet the requirements that apply to you and your visitors. We will place text you provide onto the site. Placing it is not review or approval of it.
15. Names, trademarks and availability
We do not perform trademark searches. We do not advise on whether your business name, a wordmark, a logo, a tagline or a domain is legally available for you to use or register, and nothing we say about a name or a mark is legal advice or a clearance opinion.
Design work is not a clearance. A logo we design for you may resemble a mark we have never seen. If you intend to register a trademark, or if you want to know whether your name is available at all, consult a trademark attorney before you use the work commercially. We strongly recommend doing that.
16. How the work gets made
Every design we deliver is made by hand. The concepts, the direction, the layouts, the typography, and the final files are the work of a human designer, and we do not deliver AI-generated design.
Website copy is the exception. We write your copy on Friday from your answers, and we use AI tools to help draft it. Every section is reviewed and edited by us before it goes on your site, and you review it in Friday's revision window.
We reserve the right to use AI tools elsewhere in our business, in areas that do not produce your design work. That includes scheduling, correspondence, internal notes, research and reference gathering, and general administration.
This describes our workflow and does not change Section 6, under which we do not accept AI-generated direction from you.
17. Portfolio, promotion and testimonials
After your work is delivered and paid for, we may show and describe it in our portfolio, website, social media and case studies, and identify you as a client. If you give us a review or testimonial, in any format, we may quote it and use your name, business name and town in our marketing. Tell us in writing if you would rather we did not, and we will not.
18. No guarantee of results
We warrant that our work is original or properly licensed. We make no guarantee about any business, sales, search ranking or marketing result. Those depend on factors outside our control. Except as stated in these terms, the work is provided as is.
19. Limit of our liability
To the maximum extent the law allows, our total liability arising out of or related to these terms will not exceed the total fees you actually paid us. We will not be liable for indirect, incidental, special or consequential damages, including lost profits, revenue, or the cost of reprinting or replacing materials, even if we were told they were possible.
20. Confidentiality
Each of us will keep the other's non-public business information confidential and use it only to carry out this agreement. This does not apply to information that is public, was already known, or must be disclosed by law.
21. Independent contractor
We are an independent contractor, not your employee, partner, agent or joint venturer. We are responsible for our own taxes, tools and expenses, and we control how the work gets done.
22. Events outside our control
Neither of us is liable for a delay or failure caused by events beyond reasonable control, including illness, acts of God, power or internet failure, or third-party platform failure. If either of your days is affected, we will reschedule both to the next available pair of dates at no charge.
23. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. We will first try in good faith to resolve any dispute directly, and then through mediation, before either of us goes to court. Any action that does proceed must be brought in the state or federal courts located in Callahan County, Texas, and we both consent to that jurisdiction. The prevailing party is entitled to recover reasonable attorneys' fees and costs.
24. The whole agreement
These terms, together with your booking form and your order confirmation, are the entire agreement between us and replace any prior discussion. If any part is found unenforceable, the rest stays in force. Changes must be in writing and agreed by both of us. We may update these terms for future purchases; the version in effect on the date you paid is the version that governs your purchase.
25. Acceptance
By checking the box on the booking form, typing your name in the signature field, and completing payment, you agree to these Terms of Purchase. Your typed name is your electronic signature. Electronic acceptance is valid and binding under the federal E-SIGN Act and the Texas Uniform Electronic Transactions Act. Keep a copy of your order confirmation.
