Before you sign up.
Do I have to be a Brookey client?
No. Send your logo files, fonts and colors with your first list. Setting up your files counts toward your first month's hours.
What if my list takes more hours than I have?
We ask first. Add hours at your package rate, or move the rest to next month.
Is there a limit on retainer clients?
Yes, 10 at a time. If we are full, you go on the waitlist and get a full refund.
Can I switch packages?
Yes. It starts on your next billing date.
What counts toward my hours?
Design, revisions, file prep and calls, in 15 minute blocks.
Do I own what you design?
Yes, once that month is paid.
Retainer terms.
By signing up for a monthly design retainer, you agree to the following.
- Client pricing. Client rates are for businesses whose brand was designed by Brookey Design Co. If a client rate is chosen for a brand we did not design, we will move the subscription to the public rate before any work begins, or refund it in full if you prefer.
- Fees and billing. Your package fee is billed monthly, in advance, on the date you sign up, and renews automatically until cancelled. Texas state and local sales tax is added at checkout.
- Minimum term. Every retainer has a three month minimum. After three months you may cancel anytime by emailing howdy@brookeydesign.com at least 14 days before your next billing date.
- Hours. Your package reserves a set number of design hours each billing month. Unused hours expire at the end of that month and do not roll over or carry a cash value.
- Requests and turnaround. Requests are sent by email to howdy@brookeydesign.com. Retainer work is prioritized and delivered within 7 business days of a complete request, as your hours allow. A request is complete once we have the copy, photos, sizes and details needed to start.
- Going over. If a request will take more than your remaining hours, we will tell you before starting. Extra hours are billed at your package rate only with your approval. Work outside the retainer is billed at our standard rate of $150 an hour.
- Brand setup. For brands not designed by Brookey Design Co., setting up your brand hub and organizing your files is done in your first month and counts toward that month's hours.
- What is covered. Design and website updates for your existing brand. New logos, rebrands, new website builds, photography, video, printing costs, ad spend and postage are not covered and are quoted separately.
- Availability. We take a limited number of retainer clients at a time. If no spot is open when you sign up, we will refund your payment in full and add you to the waitlist.
- Failed payments. If a monthly payment does not go through, work pauses until it is paid.
- Ownership. Ownership and usage rights to finished work transfer to you once that month's fee is paid. Brookey Design Co. may feature the work in its portfolio and marketing.
- Human led creative. AI tools may support our internal workflow, but all creative direction and design work are human led.
- Force majeure. Neither party is liable for delays caused by events beyond its reasonable control, including illness, Act of God, power or internet failure, or third party platform failure. Affected timeframes are extended by a reasonable period.
- Disputes and governing law. Any dispute will first go to good faith mediation in Callahan County, Texas. These terms are governed by the laws of the State of Texas, and any action shall be brought in the state or federal courts located in Callahan County, Texas. The prevailing party may recover reasonable attorneys' fees and costs.
